FCT Emergency Agency Bill: A necessary step or duplication of bureaucracy?

In this piece, Ekuson Nw’Ogbunka, our Managing Editor, examines Hon. Joshua Chinedu Obika’s Bill for an Act to Establish the Federal Capital Territory Emergency Management Agency (FCT-EMA).

The Bill, which has passed second reading in the House of Representatives, is a timely response to Abuja’s growing vulnerability to floods, fires, building collapses and other emergencies. However, it also raises critical questions about funding, duplication of existing agencies, and political will for implementation.

The House of Representatives this week passed for second reading HB 2408, a Bill for an Act to Establish the Federal Capital Territory Emergency Management Agency, sponsored by Hon. Joshua Chinedu Obika.

The move has been widely described as a proactive legislative intervention for a capital city that has witnessed rising incidents of flooding, fire outbreaks, building collapses and traffic emergencies in recent years.

Leading the debate, Obika painted a stark picture of the FCT as a city under pressure. He argued that Abuja hosts the Presidency, National Assembly, foreign missions and a rapidly expanding population, making it too critical to be left without a dedicated emergency architecture.

His core argument is valid. NEMA is overstretched with a national mandate. A territory-specific agency that understands local risks and can provide first-line response is consistent with global best practice.

To support this, Obika cited five international examples, the United States where Washington D.C. has its own emergency agency despite FEMA, the United Kingdom’s Local Resilience Forums, Japan’s municipal disaster councils, South Africa’s provincial centres, and Ghana’s decentralised NADMO structures in Accra.

This cross-country experience strengthens the Bill’s rationale. Capital cities everywhere maintain autonomous emergency structures. Abuja should not be an exception.

The Bill’s objectives are also comprehensive on paper. It seeks to develop a Disaster Management Plan for the FCT, conduct risk mapping, deploy early warning systems, coordinate security and medical agencies, and drive community resilience through public education.

It also proposes post-disaster functions including relief distribution, reconstruction and psychosocial support, which are currently ad-hoc and poorly coordinated in the FCT.

Crucially, Obika was strategic in addressing the cost concern. He argued that the existing FCT Emergency Management Department in Asokoro already has office space and facilities, so the new agency would not require huge capital expenditure.

However, this is where critical scrutiny begins. Is the existing Department not already performing the functions the new agency seeks to perform? What exactly is the difference between a Department and an Agency if not for autonomy and budget?

This raises the duplication question. Creating an Agency requires a Board, a Director-General, management staff, and a separate budget line. Will this not simply add to bureaucratic overhead in the FCT Administration which already has multiple secretariats and departments?

There is also the issue of inter-agency rivalry. Abuja already has the FCT Fire Service, FEMA Department, NEMA, FCT Development Control, and security agencies all responding to emergencies. Without a clear command structure, the new agency could create turf wars rather than synergy.

The financial argument that existing facilities will be used may be overly simplistic. Operational costs of a full emergency agency – ambulances, fire trucks, early warning systems, training, hazard allowances – are far beyond office space.

Furthermore, the success of emergency management is not just about law but about political will and enforcement. Abuja’s floods are largely caused by building on waterways approved by the same authorities. Building collapses are linked to poor development control. An agency cannot solve what enforcement fails to address.

Nevertheless, the Bill’s merit outweighs its risks. What Abuja needs is a legally empowered, autonomous body that can sue, be sued, hold budget, recruit professionals and be held accountable, unlike a department that is at the mercy of ministerial bureaucracy.

If properly implemented, FCT-EMA could professionalize emergency response, attract donor funding and partnerships, and reduce response time from hours to minutes.

The critical test will be at the committee stage. The lawmakers must clearly define the agency’s relationship with NEMA, provide for sustainable funding beyond federal allocation, and insulate its leadership from political patronage. Only then will the Bill move from a well-intentioned law to a life-saving institution.
